These Terms and Conditions (“Terms”) govern all scuba diving activities, training, guided dives, and equipment rentals (“Services”) provided by Sunshine State Scuba LLC (“Company,” “we,” “us,” or “our”). By booking, renting, or participating in any of our Services, you (“Participant,” “you,” or “your”) agree to be legally bound by these Terms.
Terms and Conditions – Sunshine State Scuba LLC
1. Eligibility & Health Requirements
1.1. Age: Participants must be at least 10 years of age for introductory programs and at least 12 years of age for certification courses.
1.2. Medical Condition: All participants must complete a standard scuba medical questionnaire. A physician’s written approval may be required before participation if any medical risks are identified.
1.3. Fitness to Dive: By participating, you confirm that you are physically and mentally fit for scuba diving and do not have any medical condition that may pose a risk during diving activities.
2. Bookings & Payments
2.1. A booking is confirmed once full payment or a specified deposit is received.
2.2. Payment must be made via accepted methods listed on our website or provided at the time of booking.
2.3. All prices are quoted in U.S. Dollars and are subject to change prior to booking confirmation.
3. Cancellations & Refunds
3.1. Cancellations by the Participant:
• 14+ days before the scheduled activity: Full refund minus any non-refundable deposit.
• 7–13 days before: 50% refund.
• Less than 7 days before: No refund.
3.2. No-shows or late arrivals are not eligible for refunds.
3.3. Cancellations by the Company: We reserve the right to cancel or reschedule Services due to weather, mechanical issues, instructor availability, or safety concerns. If so, participants may choose between a full refund or a reschedule.
4. Certification Courses
4.1. Participants must complete all course components, including academic reviews, confined water skills, and open water dives, to be eligible for certification.
4.2. Sunshine State Scuba LLC reserves the right to disqualify a participant from certification if safety standards, performance benchmarks, or conduct expectations are not met.
5. Guided Dives
5.1. Certified divers must present a valid certification card (or digital proof) and logbook upon request.
5.2. Divers must follow all briefings, depth limits, buddy procedures, and environmental guidelines.
5.3. The dive guide or instructor may cancel a dive or remove a diver from the water for safety concerns at their discretion.
6. Equipment Rentals
6.1. All rental equipment remains the property of Sunshine State Scuba LLC.
6.2. Participants are responsible for returning all rental gear in good condition. Damage due to misuse, loss, or negligence may incur repair or replacement costs.
6.3. You must inspect your gear prior to use and notify staff of any issues.
7. Liability & Risk
7.1. Scuba diving involves inherent risks, including but not limited to decompression sickness, equipment failure, and marine hazards.
7.2. All participants must read and sign a Release of Liability, Waiver of Claims, and Assumption of Risk Agreement before participating in any activity.
7.3. Sunshine State Scuba LLC is not liable for injuries, losses, or damages not directly caused by our gross negligence.
8. Insurance
8.1. We strongly recommend all participants carry dive accident insurance (e.g., DAN, DiveAssure) and comprehensive travel insurance.
8.2. The Company is not responsible for medical expenses, evacuation costs, or other losses arising during or after participation.
9. Conduct & Behavior
9.1. Participants must behave responsibly and respectfully toward staff, other divers, wildlife, and the environment.
9.2. Alcohol and drug use before or during diving is strictly prohibited.
9.3. We reserve the right to deny service or remove any participant who violates safety protocols or behaves inappropriately.
10. Photography & Media
10.1. Sunshine State Scuba LLC may take photos or video during activities for promotional purposes.
10.2. If you do not wish to appear in media, please inform us in writing before your activity.
11. Governing Law & Jurisdiction
These Terms shall be governed by the laws of the State of Florida, United States. Any legal action must be brought in a court of competent jurisdiction located in Florida.
